利用規約

本利用規約（以下「本規約」）は、Folomee運営事務局（以下「当サービス」）が提供するサービスを利用するすべての方（以下「ユーザー」）に適用されます。当サービスを利用した時点で、本規約に同意したものとみなします。

第1条（サービスの性質）
1. 当サービスは、カメラマン・店舗・体験ホストの情報を掲載するマッチングプラットフォームです。
2. 当サービスは、ユーザーとカメラマン・店舗との仲介・あっせんは一切行いません。
3. ユーザーとカメラマン・店舗との取引は、完全に当事者間の直接取引であり、当サービスは一切関与しません。

第2条（免責事項）
1. 当サービスは、掲載されたカメラマン・店舗の情報（経歴・スキル・実績・料金等）の正確性・完全性を保証しません。
2. ユーザーとカメラマン・店舗との間で発生したトラブル（料金トラブル・契約不履行・ハラスメント・事故・怪我・損害等）について、当サービスは一切の責任を負いません。
3. カメラマンとの実際の撮影・体験中に発生した事故・怪我・損害について、当サービスは一切の責任を負いません。
4. 店舗・体験ホストのサービス内容と実際の内容が異なる場合のトラブルについて、当サービスは一切の責任を負いません。
5. 当サービスは、予告なくサービス内容の変更・停止を行う場合があります。

第3条（禁止事項）
ユーザーは、以下の行為を行ってはなりません:
1. 法令または公序良俗に違反する行為
2. カメラマン・店舗に対する誹謗中傷・ハラスメント行為
3. 虚偽の問い合わせ・嫌がらせ目的のコメント投稿
4. 出会い目的、性的な目的でのカメラマンへの接触
5. 取引が成立したにもかかわらず、正当な理由なく一方的なキャンセル・ドタキャンを行う行為
6. 当サービスの運営を妨害する行為

第4条（コメント投稿について）
1. コメント欄への投稿内容については、ユーザー自身が責任を負うものとします。
2. コメント欄に個人情報（連絡先・住所等）を記載する場合は、自己の責任において行うものとします。
3. 当サービスは、不適切なコメントを事前通知なく削除できます。

第5条（トラブル発生時）
1. カメラマン・店舗とのトラブルが発生した場合は、当事者間で解決するものとします。
2. 必要に応じて、消費生活センター・弁護士・警察等にご相談ください。
3. 当サービスへの通報は受け付けますが、個別のトラブル解決・仲裁には対応しません。

第6条（規約の変更）
当サービスは、必要に応じて本規約を変更できるものとします。変更後の規約は、当サービス上に掲載した時点で効力を生じます。

第7条（準拠法・管轄裁判所）
1. 本規約の解釈・適用は、日本法に準拠します。
2. 当サービスに関する紛争については、大阪地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") apply to all users ("Users") of the services provided by Folomee Operations ("the Service"). By using the Service, you agree to these Terms.

Article 1 (Nature of Service)
1. The Service is a matching platform that lists information about photographers, stores, and experience hosts.
2. The Service does not act as an agent or intermediary between Users and photographers/stores.
3. All transactions between Users and photographers/stores are direct dealings between the parties concerned. The Service is not involved in any such transactions.

Article 2 (Disclaimer)
1. The Service does not guarantee the accuracy or completeness of any information listed about photographers or stores (including background, skills, track record, pricing, etc.).
2. The Service accepts no responsibility for any disputes arising between Users and photographers/stores (including payment disputes, breach of contract, harassment, accidents, injuries, or damages).
3. The Service accepts no responsibility for any accidents, injuries, or damages that occur during actual photography sessions or experiences with photographers.
4. The Service accepts no responsibility for any disputes arising from discrepancies between a store or experience host's listed services and the actual services provided.
5. The Service may modify or suspend its content without prior notice.

Article 3 (Prohibited Activities)
Users must not engage in any of the following:
1. Any act that violates laws or public morality
2. Defamation or harassment of photographers or stores
3. Posting false inquiries or comments intended to harass
4. Contacting photographers for romantic or sexual purposes
5. Unilaterally canceling or no-showing after a transaction has been confirmed, without reasonable cause
6. Any act that interferes with the operation of the Service

Article 4 (Comments)
1. Users are solely responsible for the content of any comments they post.
2. Users who include personal information (contact details, address, etc.) in comments do so at their own risk.
3. The Service may delete inappropriate comments without prior notice.

Article 5 (In Case of Disputes)
1. Any disputes between Users and photographers/stores shall be resolved between the parties concerned.
2. If necessary, please consult a consumer affairs center, lawyer, or the police.
3. The Service accepts reports of misconduct but does not mediate or resolve individual disputes.

Article 6 (Changes to Terms)
The Service may update these Terms as necessary. Updated Terms take effect upon publication on the Service's website.

Article 7 (Governing Law and Jurisdiction)
1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes relating to the Service shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
